How a Small Coin Sparked a Big Dispute
The incident occurred during a break in June 2024. A worker who had been with an unnamed private company in Brescia for 14 years bought a coffee, but the machine didn’t return his change of €1.60 (approximately $1.74). The next day a maintenance employee serviced the machine, and the worker was able to collect the change. A colleague saw the exchange, an argument followed, and the matter was referred to human resources.
Two weeks later, after an HR interview, the worker was fired for “just cause.” The company accused him of “misappropriation of money” and “threats” against the colleague who had witnessed the episode. The worker challenged the dismissal in court, where the Labor Judge of Brescia examined the case.
What the Court Decided
In court the judge considered several points. The claims of threats were judged to be “generic and not demonstrated.” It was unclear whether the maintenance worker had given permission to retrieve the change. The court also found the employer did not suffer significant economic harm from the incident. The judge ruled the dismissal “entirely disproportionate” and ordered the employer to pay compensation equal to 18 months’ salary.
The payout reflected both the finding of unfair dismissal and the worker’s 14 years of seniority at the company. The worker accepted the compensation and did not return to the job, while seeking new employment.
Why It Resonates in a Coffee-Loving Country
The case shows how small workplace disputes can become legal battles. In Italy, where coffee is a common part of daily life, an ordinary cup can acquire greater significance. Coffee rituals are part of social life there, and a minor incident can be magnified by the circumstances.
The incident also highlights the importance of proportional responses in workplace conflicts and how a small event can have major consequences for employees and employers. It raises questions about the balance between workplace rules and employee rights, illustrated here by the act of reclaiming lost change from a vending machine.
