(Pineland)- A $20,000 bond has been set for a man accused of sexual assault of a Sabine County woman after a "gathering" at a friends house on Saturday, Aug. 10.
According to the Sabine County Sheriff's Office arrest report, 42-year old Wesley Eugene Horton was booked into the Sabine County Jail on Aug. 12, 2019. Horton was charged with second degree felony sexual assault, and a felony parole warrant. The Kirbyville man remains in custody.
The Affidavit of Probable Cause states that the female victim called 911 to report the alleged sexual assault.
According to the document, Horton mingled with guest at the gathering. After leaving the party several of the guest slept at a friends home. The victim on a couch, and her fiance' on a love seat. The victim states in the affidavit that she was allegedly awakened by Horton, who she alleged was on top of her, and allegedly put his finger inside of her genitals. The victim alleged that Horton whispered that her fiance' was nearby, stating "Don't scream. This won't hurt." The victim stated that she began fighting and screaming, and yelled to her fiance'. According to the affidavit Horton fled the residence. The owners of the residence alleged that Horton did not have permission to enter the home.
The persons named here have been charged, but not proven guilty of the alleged crimes stated. This information is obtained by written request to the Sheriff's Office from Daily News and More, under the Texas Public Information Act Government Code Chapter 551.

Sec. 12.04. CLASSIFICATION OF FELONIES. (a) Felonies are classified according to the relative seriousness of the offense into five categories:
(1) capital felonies;
(2) felonies of the first degree;
(3) felonies of the second degree;
(4) felonies of the third degree; and
(5) state jail felonies.
(b) An offense designated a felony in this code without specification as to category is a state jail felony.
